Andrew Radding, of counsel at Brown, Goldstein & Levy, was quoted as a legal authority by The Baltimore Sun, in a recent story published about former Baltimore City State’s Attorney Marilyn Mosby appealing her perjury and mortgage fraud charges as her upcoming home detention sentence nears. 

Mosby was first indicted in January 2022 and had two separate trials. During her first trial, Mosby was found guilty of perjury in lying about hardships tied to the pandemic in order to withdraw retirement funds.

A federal jury also found Mosby guilty in her second trial. The jury found she committed mortgage fraud for lying on documents about a $5,000 gift her then-husband, Baltimore City Council President Nick Mosby, gave her to close on a mortgage for a Florida vacation home. 

Prosecutors say Mosby misled lenders by making false statements on mortgage applications for two properties. Her defense attorneys argue that she didn’t knowingly lie and is innocent of the charges.

Mosby is set to begin a year of home detention later this month. She avoided prison at her sentencing when U.S. District Judge Lydia Kay Griggsby sentenced Mosby to three years of supervised release, beginning with home detention.

The government also can appeal, but it is rare for prosecutors to appeal sentences that fall below federal sentencing guidelines, as Mosby’s did, Andy told The Sun.

Andy, who is not involved in the case, also told The Sun that Mosby’s appeal is more about her convictions than her sentence.

“She feels that she was prosecuted unfairly and she wants that exoneration,” Andy told The Sun. 

Mosby’s two trials were held in Greenbelt, where the defense asked for the case to be moved because of Marilyn’s profile in Baltimore.
